Notice is hereby given that the Alabama Department of Environmental Management (ADEM) will hold a Joint Public Hearing on Tuesday, December 12, 2023, at 6:00 P.M., at the Stephenson Gymnasium located on County Road 41 near Addison Elementary School (16411 County Road 41, Addison AL, 35540), concerning the proposed issuance of an air permit and proposed issuance of a National Pollutant Discharge Elimination (NPDES) Permit to Rock Creek Stone, LLC for the sandstone quarry located at 33259 U.S. Hwy 278, Addison, Alabama, 35540.  The site entrance is on the north side of U.S. Highway 278 approximately 0.45 miles west of the intersection of U.S. Highway 278 and County Road 39.

Rock Creek Stone, LLC, has applied for an Air Permit, Air Permit Number 713-0027-X001, for the operation of a sandstone crushing, screening, and conveying circuit.  Emissions would be minimized by wet suppression. ADEM has determined that the equipment/operations in the applications submitted by the company should be able to meet State and federal air pollution control requirements.

Rock Creek Stone, LLC, has also applied for issuance of a National Pollutant Discharge Elimination System (NPDES) Permit, NPDES Permit Number AL0084475, for discharges of treated drainage from a dry preparation sandstone quarry and associated areas to Rock Creek and Blevens Creek, classified as Fish and Wildlife in the Black Warrior River Basin.  The Department has tentatively determined that the actions described in this notice are consistent with the Water Quality Rules including the Department’s Anti-degradation Rules.

The purpose of the public hearing will be for interested parties to make oral and written comments into the public hearing record.  Those wishing to make oral comments at the public hearing are also encouraged to submit those comments in writing. In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed applications. All comments must address the conditions of the proposed permits; the Department’s adherence to the applicable environmental laws, rules, and regulations in development of the proposed permits; or issues that have an impact on the applicant’s ability to meet applicable environmental laws, rules, and regulations to affect the final permit decision.

Copies of the complete project file are available for public inspection Monday through Friday (except legal holidays), 8:00 A.M. to 5:00 P.M., at the ADEM Main Office at the address listed below.  For convenience, documents that exist in electronic format may be accessed in the Department's document management system, eFile.  Select Media Area “Air” or “Water”, enter the air facility number or water permit number shown above as the Permit Number, select Document Type “Permitting”, and press Search.  The most recent documents will be listed at the top by default.  The Document Type may also be left blank, which will list all available air or water files for this facility.

Attendance at the public hearing is not necessary in order to have comments included in the public hearing record.  Written comments received no later than 5:00 P.M. on Wednesday, December 13, 2023, the close of the public comment period, will also be considered and entered into the public hearing record.  Written comments should be submitted by mail or email to the Department’s named contacts below. Commenters should identify the appropriate permit number(s) on the first page of their comments.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Air Pollution Control Act, the federal Clean Air Act, Alabama Water Pollution Control Act, the federal Water Pollution Control Act, and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be posted to the Department’s eFile system. To find the response to comments and final permit determination, you may search by the air facility number or water permit number shown above.
