PROPOSED CONSENT ORDER

Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Chemical Waste Management, Inc. (EPA Identification Number ALD000622464), which operates a permitted commercial hazardous waste treatment, storage, and disposal facility located at 36964 Alabama Highway 17 North in Emelle, Sumter County, Alabama.
The violations consisted of the following: storage of hazardous waste for greater than one year, failure to mark hazardous waste containers with an indication of the hazards of the contents, failure to remove spills of hazardous waste from container storage area floors in a timely manner, failure to mark hazardous waste containers with the date of receipt, failure to transfer waste from damaged containers to containers that are in good condition, failure to keep containers of hazardous waste closed, failure to maintain adequate aisle space in permitted storage areas, failure to affix identifying labels to containers of hazardous waste, failure to maintain an impervious coating on containment system surfaces, failure to conduct adequate weekly inspections of areas where containers of hazardous waste are stored, failure to separate containers of incompatible wastes, failure to keep tank level sensing devices in working condition, failure to keep hazardous waste tanks closed, failure to maintain an impervious coating on tank system secondary containment, failure to provide tank inspection records for review, failure to conduct adequate weekly inspections of containment buildings, failure to property operate/maintain groundwater monitoring wells, failure to post “No Smoking” signs where there is a hazard from ignitable or reactive waste, failure to label containers of used oil with the words “Used Oil”, failure to minimize the possibility of releases of hazardous waste to the environment, storage of hazardous waste in an unpermitted area, storage of hazardous waste for greater than 90 days without a permit, and failure to comply with hazardous waste storage tank requirements applicable to large quantity generators of hazardous waste.
The Department is proposing a civil penalty in the amount of $90,240. The Order, if issued, would require Chemical Waste Management, Inc. to comply with all applicable requirements of Division 14 of the ADEM Administrative Code.
