FOR PROPOSED REVISIONS TO DIVISION 3 ADEM ADMINISTRATIVE CODE
AND THE
ALABAMA STATE IMPLEMENTATION PLAN

Notice is hereby given that a hearing before the Department of Environmental Management of the State of Alabama will be held at Wednesday, October 11, 2023, at 10:00 am, in the Main Hearing Room, at the ADEM – Central Office location at 1400 Coliseum Blvd. in Montgomery, to consider proposed revisions to Division 3 of the ADEM Administrative Code and the Alabama State Implementation Plan.

The Alabama Department of Environmental Management proposes to amend ADEM Administrative Code Rules 335-3-1-.02, 335-3-3-.05, 335-3-5-.10, 335-3-5-.11, 335-3-5-.14, 335-3-5-.15, 335-3-5-.16, 335-3-5-.17, 335-3-5-.19, 335-3-5-.22, 335-3-5-.23, 335-3-5-.24, 335-3-5-.25, 335-3-5-.26, 335-3-5-.28, 335-3-5-.29, 335-3-5-.33, 335-3-5-.34, 335-3-5-.35, 335-3-5-.36, 335-3-8-.11, 335-3-8-.12, 335-3-8-.16, 335-3-8-.17, 335-3-8-.18, 335-3-8-.19, 335-3-8-.21, 335-3-8-.24, 335-3-8-.25, 335-3-8-.26, 335-3-8-.27, 335-3-8-.28, 335-3-8-.30, 335-3-8-.31, 335-3-8-.35, 335-3-8-.36, 335-3-8-.37, 335-3-8-.38, 335-3-8-.43, 335-3-8-.44, 335-3-8-.48, 335-3-8-.49, 335-3-8-.50, 335-3-8-.51, 335-3-8-.53, 335-3-8-.56, 335-3-8-.57, 335-3-8-.58, 335-3-8-.59, 335-3-8-.60, 335-3-8-.62, 335-3-8-.63, 335-3-8-.67, 335-3-8-.68,  335-3-8-.69, 335-3-8-.70, 335-3-8-.71, 335-3-10-.01, 335-3-10-.02, 335-3-10-.03, 335-3-11-.01, 335-3-11-.06, 335-3-14-.03, 335-3-14-.04, 335-3-14-.05, 335-3-15-.04, 335-3-17-.01 and 335-3-17-.02, and Appendices C and G.

Revisions to the Division 3 Code are being proposed to incorporate by reference changes to the EPA’s New Source Performance Standards (NSPS), and National Emissions Standards for Hazardous Air Pollutants (NESHAPs). The definition of volatile organic compounds (VOCs) in Chapter 335-3-1 is also being proposed for revision to be consistent with EPA’s revisions.  Chapters 335-3-3, 335-3-5, and 335-3-8 are being proposed for revision to correct administrative errors. Chapter 335-3-14 is being proposed for revision to correct administrative errors, remove outdated information and remove provisions relating to violations of emission limits during start-up, shut-down and malfunctions. Chapter 335-3-15 is also being proposed for revision to remove provisions relating to violations of emission limits during start-up, shut-down, and malfunctions of equipment. Chapter 335-3-17 is being proposed for revision to Correct numbering errors and update the conformity criteria and consultation procedures. Appendix C is being proposed for revision to reflect changes to Chapters 335-3-10 and 335-3-11. Appendix G is being proposed for revision to reflect EPA’s updated list of Hazardous Air Pollutants.

Chapters 335-3-1, 3, 5, 8, 14, 15 and 17 are considered part of the federally-enforceable State Implementation Plan (SIP).  Revisions to these Chapters are proposed to be incorporated into Alabama’s SIP.

The public hearing is being held to receive data, views, and arguments from interested persons regarding the proposed rules.  Attendance at the hearing is not necessary to present such data, views, arguments, or comments as the same may be submitted in writing, but must be received by Ronald W. Gore prior to 5:00 p.m. on October 13, 2023.
